1. GENERAL TERMS OF BUSINESS
The general terms constitute an integral part of services, organization, and execution of events, activities, adventures, and tourist packages between Winedventure travel d.o.o. or an authorized travel agent on behalf of Winedventure travel d.o.o. and the passenger (hereinafter: the client) who reserves any product of Winedventure travel – planned daily excursion, private one-day excursion, private multi-day tourist package (hereinafter: tourist package). The client accepts the general terms upon reservation and/or confirmation of the service offer and they become effective immediately from the moment the client confirms the reservation/offer of the agreed tourist arrangement/service with Winedventure travel d.o.o.
2. RESERVATIONS AND PAYMENTS
The client can reserve a tourist package or service through the website www.winedventure.com, by phone, email, or through an authorized travel agent on behalf of Winedventure travel d.o.o. By making a reservation, Winedventure travel d.o.o. and the passenger agree to a specific tourist arrangement/service and all information directly related to it – duration, itinerary, reservation procedure, payment method, payment terms, etc. Upon reservation, the passenger must provide all necessary information and personal data required by the reservation form and pay the entire (100%) amount upon reservation of any planned daily tour of Winedventure travel or private daily tour of Winedventure travel. Upon reservation, the passenger must provide all necessary information and personal data required by the reservation form, and pay a 30% prepayment of the total arrangement costs for multi-day tourist trips, unless stated otherwise in the tourist arrangement. The remaining amount must be paid no later than 30 days before the departure date. If the passenger fails to pay the remaining amount of the tourist arrangement by this date, it is considered that the reservation has been canceled. In such a case, Winedventure travel d.o.o. acts in accordance with the provisions of these General Terms CHANGE AND CANCELLATION OF RESERVATION ON BEHALF OF THE CLIENT (point 5).
2.1. CREDIT CARDS
Winedventure travel d.o.o. accepts major credit cards (Visa, Visa Electron, MasterCard and Maestro) for payment of tourist arrangements. Special data is required for credit card charges, which will be processed only after submitting the completed Winedventure travel form. There are no additional charges or commissions for services paid by credit/debit card.
3. PRICE OF TRAVEL ARRANGEMENT
The price of the tourist arrangement is stated in each daily tour or travel program and becomes valid on the day of publication of each program. Prices for all arrangements are quoted in euros (EUR). Winedventure travel d.o.o. reserves the right to change prices in accordance with the Obligations Code (changes arise due to changes in exchange rates, changes in transport prices, changes in fuel prices, etc.). In the event of a change in the prices of tourist arrangements, Winedventure travel d.o.o. is obliged to inform the client no later than 20 days before the day of departure. If the price of the agreed tourist arrangement exceeds 10%, the passenger has the right to cancel the reservation without additional costs. Any cancellations in these circumstances must be made no later than 2 days after the client has been informed of the price change. Winedventure travel d.o.o. has the right to specify in the agreed tourist arrangement that the passenger must pay optional services that are part of the agreed tourist arrangement (services clearly defined under the NOT INCLUDED section), directly to the service provider on site. In such a case, the client assumes full responsibility for lodging a complaint directly with the service provider.
4. SERVICE CATEGORIES
Each tourist product clearly indicates which services are included in the total price and which are not, and are clearly visible to the client under the INCLUDED and NOT INCLUDED sections. Special services are considered as extra charges and are not included in the price of the tourist arrangement: single room supplement, different types of rooms than those specified in the tourist arrangement, additional or special meals, additional excursions, etc., clearly defined under the NOT INCLUDED section. Additionally, regardless of the costs of the tourist arrangement, the following must be paid for: visa fees, airline tickets, and fees, etc., clearly defined under the NOT INCLUDED section. The client pays for all these additional services separately (in addition to the basic costs of the arrangement). The client can express their wishes regarding special services at the time of reservation, whenever possible, for which additional charges will be incurred and covered by the client. During the trip, the passenger can purchase additional services (accommodation services, meals, excursions) that are not included in the tourist arrangement directly from the service provider, who sets the price of the service. Winedventure travel d.o.o. does not determine or control the prices of these additional services, nor does it assume any responsibility in this regard.
5. CHANGE AND CANCELLATION OF RESERVATION BY THE CLIENT
The client reserves the right to change or cancel the tourist arrangement/service by notifying Winedventure travel d.o.o. in writing (by e-mail or letter). The date of receipt of the written cancellation/notice of change is considered the basis for calculating the cancellation costs expressed as a percentage of the total cost of the tourist arrangement. In the event of a change or cancellation of the reservation by the client, the following cancellation costs apply:
- for cancellations made 31 days or more prior to departure, the prepayment amount of 30% is refundable to the client
- for cancellations made between 30 and 16 days before departure,Winedventure travel d.o.o. retains 50% of the total arrangement costs
- for cancellations made 15 days or less before departure or in case of no-show, Winedventure travel d.o.o. retains 100% of the total arrangement costs
6. CHANGE AND CANCELLATION OF RESERVATION ON BEHALF OF THE CLIENT
If Winedventure travel d.o.o. changes or cancels the agreed tourist arrangement/service before the start of the trip, Winedventure travel d.o.o. will inform the client immediately. The client has the right to accept the change, whereupon Winedventure travel d.o.o. submits a new offer to the client, or to withdraw from the agreement without paying a cancellation fee. If the client does not inform Winedventure travel d.o.o. of their decision within the specified deadline, it is considered that the client accepts the proposed changes. If the client withdraws from the contract due to significant changes made by Winedventure travel d.o.o. to the agreed tourist arrangement/service, Winedventure travel d.o.o. will refund the full amount paid for the tourist arrangement within 14 days of the date of termination of the contract. If the client cancels the reservation due to cancellation by Winedventure travel d.o.o. of the agreed tourist arrangement/service, the client has the right to a full refund of the amount paid for the tourist arrangement within 14 days of the date of termination of the contract. If the client has not received a refund within the specified period, they have the right to interest on late payment in accordance with the Consumer Protection Act. Winedventure travel d.o.o. is not responsible for additional costs incurred by the client in case of cancellation or change of the reservation.
7. CLIENT OBLIGATIONS
The client is obliged to:
- have a valid passport or personal ID card during the entire trip
- obtain all necessary visas, permits, and other necessary documentation for the trip
- follow health regulations of the country they are visiting
- comply with the customs and currency regulations of the country they are visiting
- obey house rules in tourist facilities and cooperate with service providers
- inform Winedventure travel d.o.o. in writing about any special requirements, needs, or habits that may affect the provision of services, and inform Winedventure travel d.o.o. in writing about all special requirements of the client when making a reservation
- behave responsibly and in accordance with local customs and regulations
- follow the instructions of the tour guide or other responsible person throughout the trip
- compensate for any damage caused by their own negligence or willful misconduct.
8. INSURANCE
The client is advised to take out travel insurance (health insurance, accident insurance, luggage insurance, cancellation insurance, etc.) when traveling abroad. Insurance is not included in the price of the tourist arrangement and is arranged by the passenger themselves. Winedventure travel d.o.o. recommends that the passenger take out insurance when making a reservation.
9. LIABILITY
Winedventure travel d.o.o. is liable for providing the services of the arranged tourist arrangement/service and the selection of the service provider with the care of a good business person. Winedventure travel d.o.o. is not liable for disruptions in providing services that are beyond its control (natural disasters, war, strikes, terrorist actions, restrictions by local authorities, etc.). In such cases, Winedventure travel d.o.o. will provide clients with alternative solutions to complete the tourist arrangement or cancel the tourist arrangement without any costs for the client. Winedventure travel d.o.o. is not responsible for delays or cancellations of flights, bus, train, or ship services, or for changes in the schedule of these services.
10. COMPLAINTS AND DISPUTES
The client has the right to complain about the quality of the provided services. The client is obliged to immediately report the complaint to Winedventure travel d.o.o. or directly to the service provider, verbally on the spot, by phone, or in writing, providing reasons and a description of the inadequate service. If the client is not satisfied with the solution to the complaint provided on the spot, they must submit a written complaint to Winedventure travel d.o.o. no later than 8 days after the return from the trip. Winedventure travel d.o.o. will not consider complaints received after this deadline. Winedventure travel d.o.o. will make a written decision on the complaint within 15 days of receipt of the complaint. Until Winedventure travel d.o.o. issues a decision, the client waives the right to mediation by any other person, arbitration by the Chamber of Commerce or any other institution, and the right to provide information to the media. If the client is not satisfied with the decision made by Winedventure travel d.o.o., they may initiate proceedings before the competent court in Kranj. All disputes will be settled amicably, and if an amicable settlement is not possible, the dispute will be referred to the competent court in Kranj.
11. DISCLAIMER OF LIABILITY
Winedventure travel d.o.o. is not liable for bodily injuries or damages suffered by the passenger or client during the duration of the tourist arrangement or one-day excursion as a result of: physical exertion for which the client is not prepared; acts of nature (force majeure); collisions with bicycles, pedestrians, or automobiles; road conditions, including but not limited to lack of guardrails and road surfaces affected by weather conditions; travel by plane, train, car, boat, or other means of transportation, or by bicycle, skis, horse, on foot, or other forms of active or adventure travel; consumption of alcoholic beverages; civil unrest; terrorism; equipment malfunctions; high altitude; lack of or limited access to medical care in remote locations or adequacy of medical care after provision.
Winedventure travel d.o.o. is not liable for vehicle malfunctions and instances where there is a traffic accident or road congestion. Likewise, it is not liable and responsible for the consequences and injuries when the vehicle operated by Winedventure travel d.o.o. is involved in a traffic accident.
All clients or passengers are responsible for their own safety and well- being. We do not encourage any of our clients to engage in dangerous activities or to consume alcohol excessively. The company cannot accept any responsibility if a client, for example, drinks too much or engages in dangerous activities and suffers injury, illness, death, loss, or damage as a result.
All clients should thoroughly assess their physical abilities and mental capacities to participate in the company’s excursions before making a reservation. In case of incapacity, the company may refuse the client’s participation.
12. FINAL PROVISIONS
All prices of tourist arrangements of the company Winedventure travel d.o.o. include value-added tax. By booking a tourist product/arrangement with Winedventure travel d.o.o., each client grants Winedventure travel d.o.o. permission to use all photo and video material created during the trip (photos and videos may include clients) for promotional and commercial purposes. The client is personally responsible for any inappropriate behavior or damage caused by inappropriate behavior, especially for damage caused by non-compliance with these general terms. The client is obliged to cover the damage immediately at the hotel or any other location (determined by a natural or legal person) where the damage occurred. In case of dispute between Winedventure travel d.o.o. and the client, all legal proceedings are within the jurisdiction of the court in Ljubljana. Winedventure travel d.o.o. does not assume responsibility for any errors in promotional material (catalogs, leaflets, brochures, and websites).
This general terms and conditions come into effect as of April 25, 2024, and remain valid until the next amendment/addendum.
